The Togolese Constitution promulgated as the fundamental law of the Fourth Republic provides in Article 41: "Everyone has the right to a healthy environment. The State shall ensure the protection of the environment. "

Under Article 10 of this law, "the implementation of the national environment policy is ensured by the Ministry for the Environment in relation to other departments and institutions. In this regard, the Ministry in charge of Environment follows the results of the government's policy on the environment and sustainable development and ensures that international commitments on the environment which Togo has subscribed to, are integrated into the national laws and regulations.

he Ministry of Environment has for name: Ministry of Environment and Forest Resources (MEFR). It is responsible for the implementation of the National Environment Policy (NEP, adopted December 23, 1998). The document National Action Plan for the Environment (NAPE adopted June 6, 2001), completes the NEP, and is supposed to help Togo to promote social and economic growth that is based on patterns of production and consumption friendly to environment. It aims to promote a comprehensive and rational management of the environment in order to improve the environment and living conditions of people in the context of sustainable development.

The organization and the conduct of the NEAP process were assigned to the Coordination Unit established in October 1995 and consolidated by Order No. 976002/MERF 13 March 1997. The capacity bulding of the institutions of MEFR that ensures the coordination and the monitoring of the implementation of the policy and its results among the main recommendations contained in the two documents (NEP and NEAP) adopted by the government.

The fundamental mission of MEFR is to coordinate the development and implementation of the Government's domestic environmental, forest resources and wildlife and to monitor the results by ensuring the participation of public and private institutions, local collectivities and other development actors.

The organization of MEFR revolves around four components: the cabinet, the central offices, outside agencies, organizations and institutions attached.

- Cabinet Director ;
- Cabinet officer ;
- Technical advisors and
- Missions Officers.

The Central services consist of:

- The General Secretariat;
- Management of common affairs ;
- Management of planning;
- Management of the environment ;
- Management of water and forests;
- Management of wildlife and hunting.

The decentralized services are:

- The regional directions of environment and forest resources
- The prefectural directions of environmental and forest ressources

The agencies and institutions attached to the Ministry are :

- The Interministerial Commission for the Environment (ICE) and
- The Development and forestry Board (ODEF).

To operationalize protection and environmental management actions, it is established an interministerial commission for the Environment responsible for facilitating the coordination of the State's actions regarding Environment by the study of administrative, technical or legal solutions that it requires.
